1.1. Our presentation of goods merely represents a non-binding invitation to you to order goods from us. You will receive further information, in particular on the properties of the goods, prices, delivery or shipping costs etc. from us on request and before placing your order. 1.2. Only with the sending of the order do you submit a binding offer to conclude a purchase contract.
1.3. Acceptance of the offer by us is effected by delivery of the goods. The order confirmation e-mail or the order confirmation sent by post does not yet represent an acceptance of the offer, but documents the receipt of your order and confirms all the data relating to your order, which is also part of the contract. Attached to the order confirmation you will receive our General Terms and Conditions of Business listed here. The decision whether to accept an order is at our free discretion. If we will not execute an order, we will inform you immediately.
1.4. If, during the processing of your order, we discover that the products you have ordered are not available, you will be informed of this by e-mail. A contract for the unavailable goods will not be concluded.
1.5. We sell our goods exclusively to customers who have reached the age of 18 years and only in customary quantities.
2.1. Right of withdrawal
If you are a consumer within the meaning of §13 BGB, you have the right to revoke this contract within fourteen days without giving reasons.
The right of revocation is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

Timely dispatch of the revocation or the goods is sufficient to comply with the revocation period.
2.2. Consequences of withdrawal
If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of the additional costs arising from the fact that you have chosen a different method of delivery from the cheap standard delivery offered by us), immediately and at the latest within fourteen days of the day on which we receive notification of your revocation of this contract.
We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you, and in no event will you be charged for this refund. We may refuse to make any refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without delay and in any case within fourteen days at the latest from the day on which you inform us of the revocation. This period is deemed to have been observed if you send the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods. You will only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
2.3 Exceptions to the right of withdrawal
There are legal exceptions to the right of revocation (§ 312g para. 2 BGB), whereby we reserve the right to invoke the following provision in relation to you:
There is no right of revocation for distance contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
3.1. Our shipping will take place 1 to 3 working days after the order date if possible. The estimated delivery time from the date of the binding order is approximately up to 7 days.
3.2. Compliance with the delivery time is subject to the proviso that we in turn are supplied correctly and on time. We will inform you as soon as possible of any delays that become apparent.
3.3. If the delivery time stated here is exceeded, you have the right to set a reasonable grace period with the indication that you refuse to accept the ordered goods after expiry of the period.
4.1. The prices quoted at the time of ordering shall apply. All prices include the legally valid sales tax.
4.2. The delivery and payment of the goods is on account. The invoice amount is due for payment upon receipt of the invoice and the goods and is to be settled within 10 days. In case of a previous return of delivery parts, the invoice amount can be reduced accordingly.
4.3. In individual cases payment in advance, PayPal or cash on delivery can also be agreed.
4.4. We reserve the right to deliver the goods only after payment of the prepayment invoice. We will inform the customer of this in good time in advance via proforma invoice.
4.5. If the customer is in default of payment, Hydro-Shop fbw GmbH is entitled to demand interest on arrears at the statutory rate in accordance with the relevant legal provisions. If Hydro-Shop fbw GmbH can prove a higher damage caused by delay, Hydro-Shop fbw GmbH is entitled to claim this higher damage caused by delay.
5.1. The goods remain our property until full payment.
6.1. The risk is transferred to the buyer upon delivery of the goods. This does not apply if the buyer has acted in the exercise of his commercial or independent professional activity. In this case the risk passes to the customer as soon as Hydro-Shop fbw GmbH has handed over the ordered goods to the forwarding agent, the carrier or any other person or institution designated to carry out the shipment.
7.1. The warranty is extended from 2 to 3 years
7.2. Otherwise, the statutory warranty regulations apply.
7.3. The goods must be installed and operated in accordance with the operating instructions.
7.4. If delivered articles should have obvious material or manufacturing defects, including transport damage, please complain to us immediately about such defects. Failure to do so will not, however, have any consequences for your legal claims.
Should an article not be available, we undertake to inform you immediately about the non-availability and to refund any consideration received without delay.
8.1. All content on the website, including text, graphics, photographs, images, moving images, sounds, illustrations and software is our property or that of our related companies, licensees and/or content providers. This content is protected by copyright and other rights. Their use is only permitted with our express consent.
9.1. 10.1. All contracts and agreements between the customer and Hydro-Shop fbw GmbH are subject to German law excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2. Insofar as the customer is a merchant, legal entity under public law or public special fund, our head office is the exclusive place of jurisdiction for all disputes arising directly or indirectly from this contractual relationship.
10.3. Should a provision be invalid, this shall not affect the validity of the entire contract.
